wow what a can of worms.

personally I have always thought that if pedestrians still on crossing, then wait until clear, even if lights change to green.

As has already been said, what if the pedestrian changes their mind and walks back across for whatever reason.

personally I think SE was testing knowledge to make sure you were confident in what you were saying.

However I haven't passed my part 3 yet and maybe wrong, but if I get this on my pt3 I will stick to my guns and say no DO NOT PROCEED unless crossing is clear, then discuss the reasons why.

Pelican crossings. These are signal-controlled crossings where flashing amber follows the red ‘Stop’ light. You MUST stop when the red light shows. When the amber light is flashing, you MUST give way to any pedestrians on the crossing. If the amber light is flashing and there are no pedestrians on the crossing, you may proceed with caution.

the flashing amber signal shall convey the information that vehicular traffic may proceed through the crossing but that every pedestrian who is on the carriageway or a central reservation within the limits of a crossing (but not if he is on a central reservation which lies between two crossings forming part of a system of staggered crossings) before any part of the vehicle has entered those limits, has the right of precedence within those limits over that vehicle, and the requirement that the driver of a vehicle shall accord such precedence to any such pedestrian.

Road Traffic Regulations Act

The Secretary of State may make regulations with respect to the precedence of vehicles and pedestrians respectively, and generally with respect to the movement of traffic (including pedestrians), at and in the vicinity of crossings.

Without prejudice to the generality of subsection (1) above, regulations under that subsection may be made—

with respect to the indication of the limits of a crossing, or of any other matter whatsoever relating to the crossing, by marks or devices on or near the roadway or otherwise, and generally with respect to the erection of traffic signs in connection with a crossing
and (in either case) indicated in accordance with the regulations having effect as respects that crossing; and, for the purposes of a prosecution for a contravention of the provisions of a regulation having effect as respects a crossing, the crossing shall be deemed to be so established and indicated unless the contrary is proved.

A person who contravenes any regulations made under this section shall be guilty of an offence

That last statement is complete rubbish.. it was you who was wittering on about confusing pdis and now your making misleading and inacurate staementns like that just to try and prove your right.. it really is important to you being right isnt it??

None of the copious information you have cut and paste says it is an offence to move if a pedestrain has so much as a foot on the crossing.. right of precedence is still given if the car moves when the pedestrian is 3 meters past walking away and just leaving the crossing.. examiners know this which is why most of them judge each case and dont fault it.

it is a criminal offence not to give way to a pedestrian on a crossing.. that isnt the same as playing games waiting for their foot to lift off the tarmac for tha last time as they step on to the pavement some 8-10 meters away and none of your cut and paste says it is  roll

You have quoted all that stuff and yet your assumptions and conclusions are all wrong!

Nothing there, in any of your quotes, even suggest that it is an offence to proceed at a crossing if someone is still on it.

Where in your quotes, or in the regs, does it say you have to wait until the ped is clear of the crossing? You are just making that bit up!

Everything points to the requirement "to give precedence"... that is not the same thing. Giving precedence means giving way and you can give way without needing to wait for them to clear the crossing.

Totally agree with Snax.
Only say what you can prove - and what we can prove is the fact that we need "to give precedence".
So as not to confuse the original poster any further, if anyone does wish to discuss the finer points of law on pedestrian crossings, it might be worth starting a completely new thread.

interesting but Its still referring to *giving way* to pedestrians and not waiting until they are physically completely off the crossing.

It is clearly making the point that on a straight pelican with an island  a pedestrian on the islnd and moving towards youir car is still *on* the crossing... but some drivers are moving off and not giving way at all.. hence pufins or staggered xings are preferred... as mcculde said.

So if the pedestrian is walking the other way away from the car the driver *has* given way and the crossing is effectively clear.. those minutes do not refer to that situation at all.

I sat in on a test a while back and as we approached a Zebra crossing my candidate stops to let old guy cross from our right to left. He stopped about 6 inches short of the kerb to wait for the pavement to clear so my candidate waited making a comment about the fact he hadn't got off the crossing. This is as near as dam it what the SENIOR examiner said to them " You can carry on, we can be pretty certain he isn't going to do a backward somersault back in front of you" and that was that. It really stuck in my mind because it's the 1st time I've heard him make a joke!!!!

SO, in this SE's mind, the old guy HAD crossed, he just hadn't cleared the crossing.......

I realise this post follows yours chis, it is not directed at you in anyway.

On driving test or in real world situations interpretation is open to opinion. On part 3 test, people are being tested on instructional ability.  The criteria  is;

the method, clarity, adequacy and correctness of instruction given

The examiner does not want to hear peoples personal opinions on what constitutes having crossed at a pedestrian crossing.

In strict legal terms a crossing is the width of the carriageway, the carriageway is defined in law as any part of the road to which vehicles have access. I am fully aware that on driving test D/E's do not apply the strict letter of the law. If they did every candidate who did 31 in a 30 zone would fail.

On paul's part 3 the S/E was looking for clarity of instruction when he mentioned about his "friend" telling him to "poodle on through the amber". What he wanted to hear was something along the lines of "the H/C tells us to wait until the crossing is clear". The matter would have then ended. By getting into a discussion about wether or not somebody has crossed sufficiently to proceed, anybody in a similar situation on part 3 is asking for trouble.

I have absolutely no interest in discussing the interpretation of the regs in a wider context, I do not care if people disagree about wether or not the law covers the entire width of the crossing. They are entitled to their opinion, I will not lower myself to their level of accusations of talking rubbish. If they cannot respect me, why should I respect them?

The topic is based on why paul failed his part 3. He failed in, in my opinion, partly because of the lack of clarity in his instruction and short fallings in the core competencies. He posted in an effort to help others coming up to part 3. Some of the posts on this thread, and certainly all the ones in reply to my posts, have been posted for other reasons.

Any PDI's reading this thread may be better advised to listen to the opinions of mcclude and doc. Both of whom are PDI trainers (not sure about mcclude but doc is ORDIT registered) rather than the opinions of those less qualified.

tony is worth remembering that *you* went to great lengths to misinterpet or dig out extremely obscure information to try to prove *you* were right "in the real world" as well as the Part 3 one so perhaps it realy is best if you don't "discuss" this anymore if your misleading input and desire to be seen to be right all the time is going to lead to confusion to yourself and pdis..

A driver *has* given way if he doesnt potentally inter act with the pedestrian in any way.. not just when they have left the crossing..

Why do you always resort to insutls to try to  win your own way?? most thread you are involved with seem to end with "not discussing it anymore" when it is you who is in the wrong for trying to force your opinion as fact to something which doesnt have a definite answer.. im sure that must be teling you something?? Why not just really "not discuss it anymore" instead of *braodcasting* that your not going to??

I beleive I am correct that this forum is about the members... all of them... not just with a huge ego or those selected because they agree with you on this ocasion.

Youre sentence about respect says it all.. youd have respect if you gave it occasionally.

Where did I say "not discussing it anymore", where did I insult anyone, do you consider the RTA or ZPPPGD or TSRGD obscure information, does your interpretation carry any more validity than anyone else's, what have I misinterpreted, does your saying I'm wrong make me wrong or am I wrong just because you say so?

None of those things.. you said only doc and mcculde were worth listening too so implying that those who *dont* agree with you are not.. your meaning was clear especially as  it seemsa a great many of your posts involve narky little comments or digs at others and end up the same way.

Once again - you have "given way" if you have endeavored to give right of way to a pedestrian.. none of the documents you like to refer to says otherwise.. only you did that.. rather than dig a bigger hole it would be best if you simply left it alone.

as for giving you permission to post... who said you couldnt?? I just agreed with your decisoon not to get involved any more on the grounds that you were confusing yourself and others by misinterpreting the regs for some reason.

The OP was given support and advice. It is only since the interjection of those who have given the OP no support or advise that the thread has deteriorated.


As I told you, snax muppet stated quite clearly, on another thread,  he wanted no help from me, that is why he has had no direct reply from me on this thread. I also told you why I will not entertain aspyre, save to correct his mis quoting of me.

The information paul needs to clarify what is required on part 3 is there if he takes the time to cross reference and look a little further. If he does so, he may then actually understand it, rather than taking my word, or anybody else's.

I'm imagening the discussion getting down to whether he had his
whole foot off the crossing or just the end of his big toe. big_smile
On my succesfull attempt at pt3, I gave the examiner some
wrong information about signals (you don't need to signal
when overtaking parked vehicles, with traffic comming in the opposite
direction) doing Ped Xings & Signals. He said, because of that, I got 5
instead of 6. So from this I don't think you will fail only on a mistake in your
Knowledge, but it may contribute to reducing your overall ability to pass.

Tony, you are simply wrong and cannot accept it.. To be an oracle you have to be right.

If I were you I'd be looking at the number of people I'd alienated and start asking serious questions about my atitude.. You got up my nose withing 48 hours of me joining.. Its either you or everyone else who is at fault.. I think the law of averages points us in the right direction on that one.
